Terms & Conditions

Welcome to Oops! For the purposes of these Terms & Conditions, "we," "our," and "us" refer to OAM Origin Management and/or its affiliates, as applicable, in connection with the provision of the services described herein.

 

1.       Definitions and Interpretations

  1. "Content" refers to media services, including but not limited to television programs, films, clips, and other audiovisual materials. 

  2. ​”Services" encompasses the Content, our video service, audio service, our player for viewing the Content, and any other products, features, tools, materials, or services provided from time to time through various Access Points.

  3. “Access Points" includes, collectively, mobile applications, the Oops! App, the Oops-tv.com website, and other locations where any Services are accessible, including other websites where users or website operators are authorized to embed or license Oops!.

  4. "Oops! App" means the mobile application provided by Oops! offering video-on-demand services.

  5. "Unauthorized Content" denotes Content that has not been authorized for distribution or uploading elsewhere without the express consent of OAM Origin Management.

 

2.       Description of Services and Acceptance of Terms

We provide an online video-on-demand service that enables users to select and view Content from various offerings. Your use of the Services, including access to the Content, is governed by these Terms and any end-user license agreement associated with the applicable Service. By accessing, browsing, or using any of the Services through any Access Points or other services, you agree to be bound by these Terms and our Privacy Policy, which is accessible on the Oops! App and the Oops! website (https://watch.oops-tv.com). This agreement is binding on you and all members of your household and any other individuals who use the Services under your account.

 

3.       Changes to the Terms

We reserve the right to amend these Terms periodically to reflect changes in our systems or applicable laws. Material changes will become effective immediately upon posting the revised Terms on the Oops! Website (https://watch.oops-tv.com). Your continued use of the Services through any Access Points constitutes acceptance of the revised Terms. It is your responsibility to review these Terms regularly to stay informed of any changes.

 

4.       Access and Use of the Services

  1. Age Limitations: Certain Services are not intended for use by children without parental or guardian consent. If you are under the age of majority in your jurisdiction, you must register for the Service only with parental or guardian consent, including consent to these Terms on your behalf.

  2. License Grant: During your subscription period, we grant you a non-exclusive, limited license to use the Services, including accessing and viewing the Content on a streaming basis for personal, non-commercial purposes as specified in these Terms. The availability of Content may vary based on licensing agreements and subscription terms.

  3. Content Usage Rules:

    1. You may only access and view Content for personal, non-commercial purposes and in accordance with these Terms. You are prohibited from: - Removing, altering, bypassing, or circumventing any copyright, trademark, or other proprietary notices or digital rights management mechanisms associated with the Content. - Copying, recording, downloading, streaming, reproducing, distributing, modifying, or creating derivative works based on the Content without express written permission from OAM Origin Management. - Incorporating the Content into any hardware or software application, or making it available via frames or in-line links without prior written authorization. 

    2. Content Quality: The quality of Content, including resolution, may be affected by factors such as content format, location, internet speed, and device specifications. We make no warranties regarding the quality or availability of Content.

  4. The Player: You shall not modify, enhance, remove, or otherwise alter any portion of our video Player or associated technology, including any digital rights management mechanisms. This prohibition includes reverse engineering or circumventing the Player's functionalities.

  5. Internet Service and Data Usage: Accessing the Services requires a high-speed internet connection. You are responsible for all costs associated with your internet service. Usage of the Services may count towards your data usage limits and may result in additional charges if accessed via a mobile network.

  6. Ownership: OAM Origin Management retains all rights, title, and interest in and to the Services and Content. The Services and Content are protected by copyright, trademark, and other intellectual property laws.

  7. User Responsibilities: 

    1. You agree to use the Services and Content solely for lawful, personal, and non-commercial purposes in compliance with these Terms. 

    2. You shall ensure the security and appropriate use of the Services for all users.

    3. You shall not: - Restrict or inhibit others' use of the Services. - Use the Services for unlawful purposes or in any manner not expressly authorized by these Terms. - Violate any intellectual property or proprietary rights. - Use technology to access, index, frame, or link to the Services without prior written authorization. - Introduce harmful code or interfere with the functionality of the Services. - Remove or obscure advertising associated with the Services. - Harvest user information for unsolicited communications. - Encourage unlawful conduct or compromise public safety. - Interfere with others' enjoyment of the Services.
      We may restrict or terminate your access to the Services if we determine that you have violated these Terms.

  8. Modification, Suspension, and Discontinuation: We reserve the right to modify, suspend, or discontinue the Services, including any Content or Access Points, without prior notice. We shall not be liable for any such changes or discontinuations.

 

5.         Accounts and Registration

To use the Services, you must create an account. You are responsible for all activity under your account and must ensure that others who use your account comply with these Terms. We reserve the right to terminate or restrict your account or access to the Services if we determine a breach of these Terms or for other business reasons.

 

6.         Collection and Use of Personal Information

For details on how we collect and use your personal information, please refer to our Privacy Policy available on the Oops! App and website (https://watch.oops-tv.com). By using the Services, you consent to our collection and processing of your information as described in the Privacy Policy.

 

7.         Disclaimer of Warranties, Limitation of Liability and Indemnity

  1. Disclaimer of Warranties: The Services, including the Oops! App and website, are provided on an "as is" and "as available" basis. We make no warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

  2. Limitation of Liability: To the maximum extent permitted by law, OAM Origin Management and its affiliates shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to the use of the Services.

  3. Statutory Rights: Nothing in these Terms affects any statutory rights that cannot be waived or excluded.

  4. Indemnity: You agree to indemnify and hold harmless OAM Origin Management and its affiliates from any claims, damages, liabilities, and expenses arising from your breach of these Terms or use of the Services.

 

8.         Notice and Procedure for Claims of Copyright Infringement

To report copyright infringement, please email us at enqiry@originartistic.com with the following information: (i) an electronic or physical signature of the copyright owner; (ii) a description of the copyrighted work; (iii) a description of the infringing material; (iv) your contact information; (v) a statement of good faith belief that the use is unauthorized; and (vi) a statement of accuracy and authority to act on behalf of the copyright owner. We will respond to valid notices in accordance with applicable law.

 

9.         Piracy of Content

Unauthorized distribution or uploading of Content constitutes a breach of these Terms and may result in the suspension or termination of your account. We may also seek measures to prevent further misuse, including legal action.

 

10.  Arbitration of claims

Any disputes arising out of or relating to these Terms or the Services shall be resolved through binding arbitration in Brunei Darussalam, in accordance with its laws.

 

11.  General Information

  1. International Use: Access to Content from territories where we do not have rights or where such access is prohibited is not permitted.

  2. Export Controls: Compliance with all applicable export control laws is required.

  3. Choice of Law and Forum: These Terms are governed by the laws of Brunei Darussalam. Disputes not resolved through arbitration shall be subject to the exclusive jurisdiction of the courts of Brunei Darussalam.

  4. No Waiver/Reliance: Failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. We may act inconsistently with these Terms without waiving our right to enforce them.

  5. Integration, Amendment, Severability: These Terms, including the Privacy Policy, constitute the entire agreement between you and OAM Origin Management. If any provision is found to be invalid, the remaining provisions shall continue in full force and effect.
